Judicial activism - in marriage and euthanasia
The dissenting judges Thomas and Scalia of the American Supreme Court condemned their 2015 decision in favour of so-called 'same-sex marriage', saying only was it incorrect but that the court had become a threat to democracy. The same could be said about our Constitutional Court. South Africa is faced with another case of gross judicial abuse of authority in the Stransham-Ford case, where Judge Fabricius recklessly authorised a euthanasia overturning 1500 years of precedent. Thankfully the applicant died before this could be carried out.
